Criminal Liability and Possession Disputes

New publication in the Cyprus Law Review by our Founder on the recent appellate judgment in Ccsre Real Estate Company Ltd v Theodorou Menelaou.

The publication examines the criminalisation of possession of immovable property, particularly in cases where possession originates in a contractual relationship that is subsequently disputed or terminated.

Against the backdrop of the recent judgment of the Court of Appeal of Cyprus, the analysis considers the implications for the interpretation of Article 281 of the Criminal Code, marking a significant yet controversial development in Cyprus jurisprudence.

Particular attention is given to the doctrinal and practical risks arising from the broader application of Article 281, especially where criminal law intersects with contractual and private law disputes.
